GlossaryHeara azhara

Heara azhara

הערה אזהרה

A caution on title that protects a buyer who has signed but is not yet registered.

After you sign a purchase contract, the lawyer files a heara azhara on the Tabu extract. It warns the world that this property is under contract, so the seller cannot quietly resell or pledge it out from under you. On a five-year Sde Dov presale it is not optional paperwork. If the register for the new building is not open yet, the caution sits on the parent parcel until units are subdivided.
